This report presents the
results of a study conducted for the National Highway Traffic Safety Administration
(NHTSA) to assess the highway safety effects of laws that prohibit open
containers of alcoholic beverages to be located in the passenger compartment
of motor vehicles operated on public roadways. These laws are commonly
referred to as Open Container laws.
Two methods were used to assess the effects of Open Container laws
on traffic safety: 1) A before and after comparison of data from the four
states that enacted legislation in 1999 to modify their Open Container
laws to be in conformance with the Federal Standard; and 2) A comparison
of data from states that had conforming laws when the TEA-21 Restoration
Act was enacted; adopted fully conforming laws by October 1, 2000; had
partially-conforming laws by October 1, 2000; and had no Open Container
laws at all as of October 1, 2000.
